The rules for using the Unplanned & Co. website, applying for a Growth Audit, browsing our demo catalog and receiving our text messages.
Using this website
These terms apply to this website, our application form, our demo catalog and our text messages, all run by Unplanned & Co., the business name of Ryan Bernal, a sole proprietor in Houston, Texas ("Unplanned & Co.", "we", "us"). By using the site or applying, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site.
Who can apply
The site and our services are for businesses. You must be at least 18 and have the authority to share information about the business you apply for. Please give true and current answers.
The free Growth Audit
Applying is free and does not create a contract or obligation for you or for us. We may decline any application, for example if the business is under our revenue minimum or we already work with a company in the same trade and area. The audit call and any Growth Plan we send are general, educational information based on what you tell us. They are not legal, tax, financial or accounting advice.
Our services and prices
Nothing on this website is an offer you can accept. Prices are set for each business and given in writing after the audit. If you become a client, the signed Growth Partner Agreement controls the work, prices, timelines, payment, guarantees, cancellation and ownership. If that agreement and these terms disagree, the signed agreement wins.
Guarantees and results
The guarantees described on this website are summaries. Each one applies only as written in a signed agreement, with its conditions and measurement method. We do not promise any specific number of leads, bookings, revenue or search rankings. Results depend on your market, prices, team, how fast leads are answered, ad spend and other things outside our control. Any example numbers on the site are examples, not forecasts.
Text message program
Program: Unplanned & Co. application and appointment messages. What you get: texts about your application, call times and replies, only if you check the text box or ask us to text you. How often: usually 1 to 4 messages per request. Cost: message and data rates may apply. Stop: reply STOP at any time to stop all texts; we will send one message to confirm. Help: reply HELP, or contact us through the form on our home page. Carriers are not liable for delayed or undelivered messages. Agreeing to texts is not a condition of applying or buying anything. Demo catalog
Our demo websites show made-up companies, names, reviews, prices and numbers so you can try how the system works. They are not real businesses or real customer reviews. In the catalog, texts, emails and owner tools are switched off, so nothing you enter there is sent. Please do not enter real personal or payment information on demo sites.
Our content
The text, designs, screenshots, code, photos and demo sites on this website belong to us or our licensors. You may view them and share links to them. You may not copy, resell or reuse them to build your own product without our written permission. If you become a client, your agreement explains what you own, including your domain, website content, ad accounts and customer list.
Acceptable use
Please do not misuse the site: no false applications, spam or automated submissions, no attempts to break, overload or get into parts of the site or our systems you are not allowed to, and no uploading harmful code or content that is illegal or infringes someone else's rights.
Other services
The site uses services run by others, such as Google (forms, calendar, maps and fonts), Esri (address search), Meta, Stripe and GitHub. Your use of those parts is also subject to their terms. We are not responsible for services or websites we do not control.
No warranties
The website and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the site will always be available, error-free or secure.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of this website, the audit or the Growth Plan. For anything related to this website, our total liability is limited to $100. Liability for paid services is set by your signed agreement. Some places do not allow these limits, so they may not fully apply to you.
Your responsibility
If you misuse the site or break these terms and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including attorney fees.
Texas law and disputes
Texas law governs these terms, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to fix the problem informally within 30 days. Any lawsuit about the site must be brought in the state or federal courts located in Harris County, Texas, and both sides agree to that venue.
Changes and other terms
We may update these terms; the date at the top shows the latest version, and the version on the site when you use it applies. If one part of these terms cannot be enforced, the rest still applies. Not enforcing a term right away does not mean we give it up.
